PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned order passed by the first respondent by his proceedings in Ka.No.012322/406/Ni.Pi.3/Ni.Ou.2/Ko.Thani/2022, dated 01.08.2022 and quash the same and further directing the respondents to revoke the order of suspension by considering the representation dated 1/5

O R D E R

The present Writ Petition has been filed by a Junior Engineer of the TANGEDCO seeking revocation of suspension order on the ground that it is a prolonged suspension.

2. According to the learned counsel appearing for the writ petitioner, the writ petitioner was suspended on allegations of corruption charges on 09.12.2021 and he also been implicated in Crime No.7 of 2021, which is pending trial in S.C.No.1 of 2023.

3. The petitioner has sent a representation to the first respondent herein on 26.09.2022 seeking to revoke the order of suspension on the ground that it is a prolonged suspension. The petitioner had filed a petition in W.P(MD) No. 23461 of 2022 seeking to quash the order of suspension. This Court, by an 2/5

order, dated 12.10.2022 found that only ten months have elapsed, since the petitioner was suspended. This Court has given liberty to renew his prayer for reinstatement after lapse of some more time. Therefore, the present writ petition has been filed seeking to quash the order of suspension.

4. Considering the facts that the petitioner is about to complete the two years of suspension, the first respondent is hereby directed to consider the representation of the writ petitioner, dated 26.09.2022 in the light of the G.O. (Ms).No.81, Human Resources Management (N) Department, dated 04.08.2022 and pass orders within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
