Heard both sides.
2.The petitioner's son suffered severe injuries on account of assault by three named accused on 01.10.2023. Crime No.364 of 2023 was registered on the file of Checkanurani Police Station for the offences under Sections 341, 294(b), 323, 324 and 506(ii) of IPC and Sections 3(1)(r), 3(1)(s) and 3(2)(va) of SC / ST (Prevention of Atrocities) Act, 1989. The petitioner's son was admitted in Madurai Rajaji Government Hospital. The petitioner's son is said to have suffered fracture in both the hands. He had also suffered some head injury. The petitioner's son is said to have received life threat also. The petitioner alleges that her son 2/4
is not yet to be cured and that he requires further treatment. She does not want the hospital authorities to discharge his son. 3.When the matter was taken up for hearing, the learned Additional Government Pleader submitted that though discharge summary was originally prepared, it has been cancelled and that the petitioner's son is continuing to take treatment in the ward.
4.Considering the special facts and circumstances, I direct the third respondent to continue to give treatment to the petitioner's son and only after the third respondent is personally satisfied that the petitioner's son can be discharged, he shall be discharged. In any event, the petitioner's son shall continue to be in the hospital for not less than ten days. 5.This writ petition is disposed of accordingly. No costs.
