PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 4 and 5 to implement the order in G.O(Pa) No.319, Municipal Administration and Drinking Water Supply (Peru.1) Department dated 13.06.2024 and consequential proceedings of the second respondent in Na.Ka.No.10509/ 2019/A3, dated 11.07.2024 by regularizing the period of removal from service (ie) 3234 days as duty period and consequently direct the respondents 4 and 5 to disburse all terminal and pensionary benefits with interest to the petitioner, within a time frame as fixed by this Court. O R D E R

The instant writ petition has been filed by a retired Record Clerk of the fifth respondent Town Panchayat, seeking a Mandamus as against the respondents 4 and 5 to implement G.O(Pa) No.319, Municipal Administration and Drinking Water Supply (Peru.1) Department, dated 13.06.2024.

2. A perusal of the said Government Order reveals that the petitioner has retired from service on 30.06.2019. Earlier he was terminated from 2/5

service on 24.03.2009 and he was reinstated on 29.01.2018. This period was sought to be regularized by the writ petitioner. Accepting the request of the petitioner, the above said Government Order has been issued by the Principal Secretary to Government regularizing the period with monetary benefits. A consequential order has also been passed by the second respondent on 11.07.2024, directing the third respondent to release the monetary benefits. However, so far the respondents 4 and 5 have not implemented the said Government Order and the consequential order passed by the second respondent herein. Hence, the present writ petition.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

Considering the above said facts, the respondents 4 and 5 herein are directed to implement G.O(Pa) No.319, Municipal Administration and Drinking Water Supply (Peru.1) Department dated 13.06.2024 and release all the eligible terminal and pensionary benefits to the writ petitioner, within a period of twelve weeks from the date of receipt of a copy of this order. 3/5

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
