This petition has been filed to withdraw and to transfer the case in H.M.O.P.No.500 of 2022 on the file of the learned Family Court, Coimbatore to the learned Family Court, Dindigul. 1/4

2.The facts in brief:

The marriage between the parties was solemnized on 14.09.2020. Thereafter, the petitioner was harassed by the respondent and her in laws. Hence, they separated from each other. Due to the dispute between them, the respondent filed H.M.O.P.No.500 of 2022 on the file of the Family Court, Coimbatore. It is for the petitioner to inconvenient to travel for every hearing to Coimbatore. Hence, seeking transfer of the above said H.M.O.P proceedings to the Family Court, Dindigul, this petition has been filed.

3.Heard both sides.

4.The learned counsel for the respondent would submit that the respondent is now in abroad and he has no objection to transfer the case. But since he is in abroad, he can appear before the Family Court, if so he was permitted. In this regard, he moved a petition before the Family Court, Coimbatore.

5.Considering the facts and circumstances of the case and 2/4

considering the convenience of the wife, the H.M.O.P.No.500 of 2022 filed by the respondent along with the interlocutory application, on the file of the Family Court, Coimbatore, is ordered to be withdrawn and transferred to the Family Court, Dindigul.

6.Accordingly, this transfer civil miscellaneous petition is allowed. No costs. Consequently, connected miscellaneous petition is closed. 15.02.2024 NCC :
