PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st Respondent to transfer the 5th Respondent complaint to the competent jurisdictional authority or some other independent investigation agency and conduct a fair investigation, based on the petitioner's representation dated 10.10.2023.

2. The learned Government Advocate (Crl.Side) would submit that on the basis of the complaint given by the wife of the petitioner, enquiry is underway in CSR. No.612 of 2023. Summons were issued to both side parties. Both parties are 2/5

not co-operated for the enquiry.

3. Since it is the matrimonial issue, there is no question of transfer of enquiry. Let the above said enquiry be completed within a month, for which, the petitioner and the respondents 4 and 5 are directed to co-operate. If any trouble arises during the course of enquiry, the petitioner can workout his remedy through appropriate proceedings.

4. With the above said direction and liberty, this Criminal Original Petition is disposed of.
