PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to call for the records with regard to the final report in Spl.C.C. No.2 of 2023, on the file of the Judicial Magistrate Court, Manapparai, Tiruchirappalli District and set aside the same and consequently direct the 2nd Respondent to conduct further investigation in FIR No.245/2023, pending on the same file of the 2nd Respondent herein and file a fresh final report within stipulated time fixed by this Court. 1/4

Side) O RDER This Criminal Original Petition is filed to call for the records with regard to the final report in Spl.C.C. No.2 of 2023, on the file of the Judicial Magistrate Court, Manapparai, Tiruchirappalli District and set aside the same and consequently direct the 2nd Respondent to conduct further investigation in FIR No.245/2023, pending on the same file of the 2nd Respondent herein and file a fresh final report within stipulated time fixed by this Court.
2. Heard both sides.
3. The grievance of the petitioner is that he has given a complaint making allegations against the accused that he has criminal intimidated and outraged the modesty of the petitioner's wife.
4. Learned Government Advocate (Crl.side) has produced the original complaint given by the petitioner. Reading of the complaint does not show anything regarding the abusive words used by the accused persons. 2/4
5. Learned counsel for the petitioner submitted that on the very same date, he has sent another complaint making the other allegations against the accused persons.
6. The above said complaint copy is not available either in the petition filed by the petitioner or in the CD file. If the petitioner has any grievance, he can express it, during the course of recording evidence before the trial Court. At this stage, there is no question of setting aside the final report or to transfer the investigation, as the case may be.
