For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- To enlarge the petitioner on bail in crime no. 659/2016 on the file of the respondent police station in S.C.No.59 of 2021 on the file of the Fast /Mahila Court at Dindigul and thus render justice.
ORDER : The Court made the following order :- The petitioner / Accused No.7, who was arrested and remanded to judicial custody on 22.08.2024 and was facing trial for the offences under Sections 120(b), 147, 148, 341, 326, 506(ii), 302 r/w 149 IPC in S.C.No.59 of 2021, on the file of the learned Fast Track Mahila Court, Dindigul District, seeks bail.
2. Earlier bail application filed by the petitioner in Crl.O.P.(MD).No.17106 of 2024 was dismissed by an order dated 04.10.2024. This Court had taken into consideration the fact that the petitioner was absconding for more than two years and non bailable warrant was pending against the petitioner. In view of the same, there was no progress in the case.
3. When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondent Police brought to the notice of this Court that the other accused persons were absent and non bailable warrant was issued against Accused No.10 and he surrendered and the non bailable warrant was recalled.
4. It is quite evident that the accused persons want to prolong the trial by being absent one after the other. There has been absolutely no progress in the trial and not even a single witness has been examined in this case.
5. In view of the above, unless there is some progress in the trial, this Court is not inclined to entertain this criminal original petition and accordingly, the same stands dismissed.
