PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents herein to count the petitioner's service from 11.09.1987 to 28.02.2009 as qualifying service for pension along with his regular service from 01.03.2009 to 31.05.2024 in the Government School and accordingly re-fix his pay from the dated of initial appointment and disburse all the consequential and monetary benefits thereof by including his name under the old pension scheme by considering the petitioner's representation dated 29.08.2024 within a stipulated period of time to be fixed by this Court.

ORDER

The instant writ petition has been filed by a PG Assistant Teacher seeking a mandamus to consider his past services in an unaided institution for the purposes of calculating his pensionable service and to bring him under the Old Pension Scheme.

2.The petitioner has sent a representation to the above said effect to the third respondent on 29.08.2024. Since the representation has not been considered, the present writ petition has been filed. 3.Considering the above said facts, the third respondent herein is directed to dispose of the representation of the writ petitioner on merits and in accordance with law within the period of twelve weeks from the date of receipt of a copy of this order.

4.With the above said observations, this writ petition stands disposed of. No costs.
