... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Declaration, to declare the framing of wrong answer key in respect of the Direct Recruitment to the Post of Post Graduate Assistants in History Subject and the consequential provisional selection list published by the 2nd respondent dated 10.09.2022 as illegal and consequently for a direction, directing the respondents to award 6 marks for the 1/4
question Nos.12, 62, 69, 89, 94 and 102 (Final Answer Key questions) and select the appoint the petitioner in the Post of Post Graduate Assistant in History within the time period stipulated by this Court. For Petitioner : Mr.T.Lajapathi Roy For Respondents : Mr.V.R.Shanmuganathn, Standing Counsel.
ORDER
Heard the learned counsel for the writ petitioner and the learned standing counsel for the respondent board.
2.The petitioner was a candidate who took part in the subject recruitment process. She questions the correctness of the petition mentioned final key answers. Even though the contentions advanced by the learned counsel for the writ petitioner are attractive and persuasive, I am not in a position to even entertain the writ petition.
3.The learned standing counsel drew my attention to the order dated 15.11.2022 made in W.P.(MD)No.25868 of 2022. In the said case, even while sustaining the contentions of the writ petitioner, I made it clear that I would not 2/4
grant relief to similarly placed candidates, even if they approach the Court. That is because in matters such as this finality has to reach at some point of time. I am conscious that the individual petitioner may feel aggrieved but then we cannot afford to open floodgates. The selection list was published on 17.09.2022. The appointment orders for P.G. Assistant in various discipline were issued on 14.10.2022. If the petitioner had immediately come after publication of the selection list and before the issuance of appointment orders, this Court would have probably considered and examined the petitioner's contentions. This writ petition came to be filed only on 21.11.2022. In these circumstances, it is not possible to grant relief. The writ petition is hit by laches. Hence, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
