O R D E R

This writ petition has been filed seeking a Writ of Mandamus, directing the respondents to take action on the complaint dated 07.08.2023.

2. The grievance of the petitioner is that due to land dispute between the petitioner and his brother and sister, a false complaint has been given against the petitioner's son and daughter-in-law. The accused persons have also made life threat to the petitioner and thrown the petitioner out of his own house. On that basis, the petitioner has made a complaint dated 07.08.2023 to the first respondent and the same was forwarded to the second respondent. The second respondent, under the guise of enquiry, forced the petitioner to settle the issue amicably with the accused persons. Seeking proper action to be taken against the accused persons on the basis of his complaint, this writ petition has been filed.

3. Learned Additional Public Prosecutor would submit that enquiry is pending on the complaint given by the petitioner. 2/4

4. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

5. Considering the submissions of both sides, there shall be a direction to the respondent to enquire the complaint on its own merits, within a period of fifteen(15) days from the date of receipt of a copy of this order, by summoning the petitioner and also the counter parties.
