PRAYER :- To call for the records pertaining to the impugned FIR in Crime No.55 of 2022 on the file of the respondent police and to quash the same as against the petitioner.

Crl.OP.(MD)No.18996 of 2023 ORDER: The Court made the following order :- This criminal original petition is filed to quash the impugned FIR in Crime No.55 of 2022 on the file of the respondent police 2.After chemical analysis, the report states that it is not narcotic substance but it is some kind of powder / salt. Therefore, the respondent cannot proceed further under NDPS Act. However, the respondent has altered the section as 420. Therefore, the criminal prosecution may proceed under Section 420 alone.

3.With the above said observations, the impugned FIR is quashed to the extent stated supra and the criminal original petition is partly allowed. Consequently, connected miscellaneous petition is closed. 06.01.2026 TMG TO 1.The Inspector of Police, Rameswaram Town Police Station, Ramanathapuram District.
