ORDER

On 13.07.2019, the petitioner and her husband went to worship their family deity. Thereafter, the petitioner's husband went missing. Consequently, a complaint was lodged in Crime No. 281 of 2019, and the case was registered as a 'Man Missing'.

2. The respondent police took further action to locate him but failed. Hence, a Habeas Corpus Petition was filed. The same was dismissed, as there was no indication of illegal detention and it was only a 'Man Missing' case. However, the respondent police were directed to continue the investigation.

3. The respondent police submitted that inspite of efforts they could not trace the missing man or his mobile number. Despite their earnest efforts they could not trace the missing person.

4. Therefore, this Court is of the considered opinion that the transfer of investigation would not result in any fruitful result. Hence, the prayer to transfer of investigation cannot be entertained. 2/4

5. Accordingly, this Criminal Original Petition is closed. However, the petitioner is at liberty to approach the respondent police to obtain a missing person certificate, after the lapse of the statutory limitation period as prescribed under law.
