JUDGMENT
(Judgment of the Court was delivered by M.S.RAMESH, J.) Challenge is made to the order of the writ Court dated 27.09.2024 in W.P.(MD) No. 23219 of 2024.
2.On the ground that the appellant herein is physically challenged and hence, he ought not to have been transferred to any other office from Trichy to Dindigul District, when he had preferred the writ petition by placing reliance upon the letter dated 22.07.2009 issued by the Chief Secretary to Government, the learned Single Judge had dismissed the same, by an order dated 27.09.2024. The order of dismissal is under challenge before us.
3.During the pendency of the appeal, we had called upon the learned Additional Government Pleader to explore the possibilities of 2/5
accommodating the appellant inside Trichy District itself in view of his physical ailment.
4.Today, when the matter is called, the learned Additional Government Pleader, on oral instructions from Mr.G.Subramanian, Chief Water Analyst, Department of Public Health and Preventive Medicine, Chennai, submitted that there is a vacancy in the post of Office Assistant at the office of the Designated Officer in the Food Safety and Drug Administrative Department, Tiruchirappalli, in which they are willing to accommodate the appellant herein and such order of transfer will be passed at the earliest.
5.To such an offer, the learned counsel for the petitioner also expressed his willingness to join at Trichy.
6.As such, the grievance of the appellant stands redressed and no further orders are required to be passed in this writ appeal. Accordingly, this Writ Appeal stands closed with a direction to the first respondent herein to pass appropriate orders as aforesaid as expeditiously as 3/5
possible. No costs. Consequently, connected miscellaneous petition is closed.
