A document sought for registration was kept pending by the Sub-Registrar on the grounds of undervaluation, and proceedings under Section 47-A(1) of the Indian Stamp Act were initiated. Being aggrieved, a Writ Petition was filed seeking return of the document after due registration. The learned Single Judge taking note of the fact that adjudication had already been completed and the difference in stamp duty had been fixed by an order dated 05.02.2014, directed the writ petitioner to pursue his remedy by preferring an appeal before the Inspector General of Registration. Being aggrieved, the present Writ Appeal has been filed. 2/5
2. However, the learned counsel for the appellant would submit that the appellant is willing to pursue his remedy through adjudication under the Samadhan scheme and sought liberty to make a representation to the Inspector General of Registration.
3. Taking into consideration the said submission and the law in force, liberty is granted to the writ appellant to make a representation before Respondents 1 and 2 within a period of 15 days from today. Upon receipt of such representation, appropriate orders shall be passed in accordance with law, preferably within two months.
4. In view of the above, the Writ Appeal stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
