ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the learned Judicial Magistrate No.I, Ramanathapuram to expedite the trial in S.T.C.No.21 of 2017 within a time frame fixed by this Court.

2. When the matter was taken up for hearing on 29.11.2022, considering the submission made by the learned counsel for the petitioner, this Court directed the Registry to get remarks from the concerned Magistrate regarding the long pendency of S.T.C.No.21 of 2017.

3. In pursuance of the same, the learned Judicial Magistrate No.I, Ramanathapuram has submitted a report dated 07.12.2022 stating the case stands posted for trial. But the learned Magistrate has not stated anything about the reason for long pendency of the case and as to whether the accused has been appearing regularly.

4. It is evident from the records that the present complaint was lodged under Section 200 Cr.P.C. for the offences under Sections 138 r/w 142 of Negotiable Instruments Act.

5. Considering the fact that the case is pending from 2017, the trial Court is directed to complete the trial and dispose of the case in S.T.C.No.21 of 2017 within a period of two months from the date of 2/4

receipt of a copy of this order. Further, the Registry is directed to call for an explanation from the learned Judicial Magistrate No.I, Ramanathapuram as to why he has not submitted remarks, despite specific direction issued.

6. With the above direction, this Criminal Original Petition stands disposed of.
