Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.122/2024 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 417, 420 IPC in Crime No.122 of 2024 on the file of the respondent police, seeks anticipatory bail. 1/3

2.When the matter came up before this court, during the previous hearing, the learned counsel for the petitioner submitted that the entire amount has been repaid back to the depositors. To get instructions, the matter is posted today. 3.When the matter was taken up for hearing today, the status report was filed by the respondent and a stand has taken to the effect that there are totally 94 depositors and a total amount of Rs.10,28,000/- has been collected from them. The said amount has not been repaid. It is further stated in the status report that the petitioner has repeatedly given undertaking that he will settle the amount, if the customers produced necessary document. However, he has not settled the said amount.

4.The learned counsel for the petitioner submitted that whatever amounts are due and payable to the depositors has been repaid back to them. If there is any further amount due and payable, he is ready to settle to the depositors, if they produce the necessary document.

5.Taking into consideration the facts and circumstances of the case and nature of allegations made, this is not a fit case for grant of anticipatory bail. If the petitioner is intending to repay the depositers, he has to show his bona fides before the respondent Police, failing which, the respondent Police shall proceed with custodial interrogation. Except giving this clarity, no further order is required to be passed in 2/3

this petition.
