Criminal Appeal filed Under Section 14 A (2) of SC/ST(POA) Act, 1989 as amended by Act 1/2016 pleased to call for the entire records in relating to the
impugned order dated 05.07.2024 made in Crl.M.P.No.1002 of 2024 before the learned Sessions Judge, Special Court for the exclusive trial of SC/ST Cases, Ramanathapuram, and to set aside the same and consequently to release the appellant on bail in connection with the FIR in Crime No.119 of 2018 on the file of the 2nd respondent police, which tried in Special Sessions Case No.10 of 2019 on the file of the learned Sessions Judge, Special Court for the exclusive trail of SC/ST Cases, Ramanathapuram.
ORDER:- This Criminal Miscellaneous petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.S.Jeyakarthik, Advocate for the Petitioner and of Mr.M.Sakthi Kumar, Government Advocate(Criminal side) for the first and second respondents, and this Court made the following order: This petition has been filed to relax the condition imposed on the petitioner vide order dated 23.07.2024 made in Crl.A.(MD).No.591 of 2024 on the file of this Court.
2.As per the direction of this Court dated 12.11.2024, the learned Special Court for Trial of Cases registered under SC/ST (POA) Act, Ramanathapuram, sent a report before this Court and the same is as follows;
3.From the perusal of the report, it is seen that the petitioner did not appear on 01.09.2024, 15.09.2024, 16.09.2024, 24.09.2024 to 26.09.2024, 26.10.2024, 28.10.2024, 29.10.2024 to 30.10.2024 and 07.11.2024 to 12.11.2024. 4.In view of the above report, the petitioner is directed to appear before the trial Court, once in a week, ie., on every Monday at 10.30 a.m., until further orders. 5.This petition is ordered accordingly.
