ORDER
The petitioner has prayed for issuance of a Writ of Mandamus, directing the first respondent to dispose of Na.Ka.No.27699/2016/AA6, dated 21.08.2018, pending on his file, within a time frame.
2. Heard Mr.R.Chandrasekar, learned counsel appearing for the petitioner and Mr.D.Gandhiraj, learned Special Government Pleader, who takes notice for the respondents. By consent of both sides, the Writ Petition is taken up for final disposal at the admission stage itself.
3. According to the learned counsel for the petitioner, the properties in question originally belonged to the petitioner's grandfather by purchase in the year 1943. Thereafter, the said properties devolved on the petitioner's father and after his demise, the petitioner is in possession and enjoyment of the same. During the UDR Scheme, by mistake, the petitioner's father's name was removed and the names of Jayachandran, Veerasamy and Selvaraj had been entered in the Patta. In order to rectify the same, the petitioner has sent a representation dated 10.10.2014 and the same was allowed by the second respondent on 28.07.2016 and the names of the petitioner, his mother and sister were included in the Patta. Challenging the same, the said Veerasamy, Selvaraj and others filed an appeal before the first respondent in Na.Ka.No. 2/5
27699/2016/AA6, dated 21.08.2018. However, the same has not been considered so far. Therefore, the petitioner has approached this Court by way of filing the present Writ Petition for the relief stated supra. 4.
The learned Special Government Pleader appearing for the respondents submitted that the appeal would be considered and appropriate orders would be passed on merits and in accordance with law, within a time frame.
5. Recording the aforesaid submission made by the learned Special Government Pleader appearing for the respondents, this Court, without going into the merits of the matter, directs the first respondent to consider and dispose of Appeal No.Na.Ka.No.27699/2016/AA6, on merits and in accordance with law, after providing an opportunity of hearing to all the necessary parties concerned, within a period of twelve weeks from the date of receipt of a copy of this order.
6. This Writ Petition stands disposed of with the above direction. No costs.
