ORDER

The Criminal Original Petition has been filed seeking orders to direct the third respondent not to harass the petitioner on the guise of enquiry without any complaint and by following due process of law by considering the representation given by the petitioner dated 04.10.2024.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondents would submit that the petitioner is having five previous cases, in which, he was acquitted in one case and in another case under Section 9 of Tamil Nadu Gaming Act, he was convicted and two other cases are pending for trial and one case was referred as Mistake of Fact. He would further submit that the petitioner is a history sheeted person in H.S.No. 246 of 2013 and he was bound over for one year period in M.C.No.123 of 2023 dated 31.10.2023.

3. The learned counsel appearing for the petitioner would submit 2/4

that the petitioner is not having any cases recently and under the guise of retaining the history sheet, they have been harassing the petitioner continuously.

4. Considering the above facts and circumstances, the respondents are directed not to harass the petitioner in anyway.

5. With the above direction, this Criminal Original Petition stands disposed of.
