Mr.R.Suresh Kumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the petitioner on bail in the event of his arrest in NBW issued in SC No.304/2008 on the file of the III Additional District and Sessions Court, Pattukottai in Cr.No.320/2002 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A6 who apprehends arrest at the hands of the respondent police in S.C. No.304 of 2008 on the file of the III Additional District and Sessions Court, Pattukottai for the offences punishable under Section 397 IPC in Crime No.320 of 2002, seeks anticipatory bail.

2.The petitioner was absent during the trial in S.C. No.304 of 2008 on the file of 1/3

the III Additional District and Sessions Court, Pattukottai. Therefore, Non-Bailable Warrant came to be issued.

3.The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

4. The learned Government Advocate(Crl.side) objected to grant anticipatory to the petitioner.

5. Taking into consideration the facts and circumstances of the case this Court is not inclined to grant anticipatory bail to the petitioner.

6. Hence the petition stands dismissed with liberty to the petitioner to appear before the trial Court and file an application to recall the Non Bailable Warrant issued against him and on filing such application the trial Court is directed to consider the same and pass orders on merits and inaccordance with law. sd/- 16/10/2023 / TRUE COPY / /10/2023 Sub-Assistant Registrar (C.S.)
