PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the Respondent Nos.1 and 2 to directing the Respondent No.3 for not to harass the petitioners in the name of the enquiry and based on 1st Petitioner's representation dated 10.10.2023 in accordance with law. For Petitioners : Mr.R.Rajaselvan For R1 to R3 : Mr.M.Sakthi Kumar Government Advocate (Crl. Side) O RDER This Criminal Original Petition has been filed to direct the respondent Nos. 1 and 2 to directing the Respondent No.3 for not to harass the petitioners in the name of the enquiry and based on 1st Petitioner's representation dated 10.10.2023 in accordance with law.
2. Learned counsel for the petitioner submitted that the first petitioner is the husband and the petitioners 2 to 4 are the in-laws of the fourth respondent herein. They are having two female children. Due to difference of opinion, they got separated and the fourth respondent has filed petition for divorce before the 2/5
learned Judicial Magistrate, Athoor, Dindigul. She has also preferred a complaint before the respondents. On that basis, the respondents 1 to 3 are harassing the petitioners on the basis of enquiry. Hence the first petitioner made representation before the respondent not to harass them. Since the same was not considered, the present petition came to be filed.
3. Learned Government Advocate (Crl.side) submitted that on the basis of the complaint given by the wife of the fourth respondent herein, enquiry is undertaken in C.S.R.No.739 of 2023. The matter is pending for enquiry.
4. It is seen that it is matrimonial dispute between the husband and wife. Let the enquiry be completed within a period of 15 days from the date of receipt of a copy of this order. If any trouble arises during the course of enquiry, the petitioners are at liberty to work out remedy through appropriate proceedings. There is no question of harassment. The respondent has to send for conciliation parties to settle the issue. Thereafter, only depending on the result, the respondent can take further action.
