4. The learned counsel for the petitioner submitted that the property in Survey No.98/5A situated at Neduvasal Melpathi Village, Alangudi Taluk, Pudukkottai District is owned by the petitioner. The petitioner seeking to survey the said land in order to fence his property, made an application before the third respondent and paid necessary fee. Hence, the petitioner made a representation to the third respondent to survey the property of the petitioner again. The same has not been considered. Hence, the petitioner has filed this present writ petition with the aforesaid prayer.
5. No prejudice would be caused to the official respondents, if the representation of the petitioner dated 29.08.2022 seeking to survey and demarcate the petition mentioned property of the petitioner, is considered on merits and in accordance with law, after hearing the petitioner as well as the rival claimants, if any.
6.Accordingly, this Court, without expressing any opinion on the merits of the matter, directs the official respondents to consider the representation of the petitioner, dated 29.08.2022 seeking to survey and demarcate the property 3/5
