ORDER

This petition has been filed to withdraw the case H.M.O.P.No.885 of 2022 on the file of Family Court, Madurai District, to transfer the same to on the file of Family Court, Ramanathapuram Ramanathapuram 1/4

District for adjudication.

2.The facts in brief:

The marriage between the parties was solemnized on 08.12.2021. But, after that the respondent and his family members harassed the petitioner and her family members by demanding more dowry. Therefore, there was dispute arose between them. All the efforts taken by the elders of the family members ended in vein. But, the respondent filed the above said H.M.O.P. proceedings on the file of the Family Court, Madurai seeking restitution of conjugal rights. The petitioner is now residing at Ramanathapuram. Hence, she seeks transfer of the same to the Family Court, Ramanathapuram. For that purpose, this petition has been filed.

3.Heard both sides.

4.The learned counsel for the respondent would submit that the respondent has no objection to transfer the case to the file of Family Court, Madurai.

5.Considering the facts and circumstances of the case and considering the convenience of the wife, the H.M.O.P.No.885 of 2022 filed by the respondent on the file of the Family Court, Madurai, is ordered to be withdrawn and transferred to the Family Court, Ramanathapuram.

6.Accordingly, this transfer civil miscellaneous petition is allowed. No costs. Consequently, connected miscellaneous petition is closed. 20.02.2024 NCC :
