O RDER This Criminal Original Petition is filed to direct the Learned Judicial Magistrate No.I, Nagercoil, to expedite the trial in CC No.54 of 2021 and conclude the same, within the time stipulated by this Court.

2. Heard both sides.

3. Eventhough, the occurrence is of the year 2016 and the case is of the year 2019, the grievance of the petitioner is that still no progress is made in the trial process.

4. Learned Government Advocate (Crl.side) would submit that because of the vacancy position in the Additional Public Prosecutor Grade II in the concerned Court, trial could not be commenced.

5. The reason stated by the learned Government Advocate (Crl.side), may not be a proper reason for the delay. Let the trial process be completed within a period of five month from the date of receipt of a copy of this order, considering the oldness of the crime.
