For Respondent : Mr.K.Sanjai Gandhi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.5 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 406, 420, 120(B), 5 of TNPID Act, 1997 IPC in Crime No.5 of 2022 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution, as per the de-facto complainant is that the petitioner informed the defacto complainant that if he invests the amount in "Aishwarya Gold House" the same will be doubled within two months and induced them and recieved deposits and thereby, cheated her by not retuning the money. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and she has been falsely implicated in this https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.21088 of 2022 case. She would further submit that the petitioner is the wife of A2 and she is in no way connected with the offence and seeks anticipatory bail.

4. The learned Government Advocate(Crl. Side) would submit that the petitioner along with other accused have received a sum of Rupees Seven Crores from various persons in the guise of doubling the amount and subsequently, cheated them. He further submitted that the husband of the petitioner was arrested and later, released on statutory bail and after coming out on bail, he is not cooperating for investigation and no amount has been recovered from them and hence, he opposes to grant anticipatory bail to the petitioner.

5. Heard the learned counsel appearing on either side and perused the materials on record. Taking into consideration the facts and circumstances of the case and that the amount involved in this Crime is very huge and that no amount has been recovered so far and that the petitioner's husband is not co-operating for investigation, this Court is not inclined to grant anticipatory bail to the petitioner.
