PRAYER: Criminal Original Petition is filed under Section 439 (2) of Cr.P.C. to cancel the bail granted in favour of the 2nd respondent /sole accused in Crl.M.P.No.148/2023 dated 23.01.2023 on the file of the Principal District Sessions Judge, Pudukkottai. O RDER This Petition has been filed to cancel the bail granted in favour of the second respondent /sole accused in Crl.M.P.No.148/2023, by an order dated 23.01.2023, on the file of the learned Principal District Sessions Judge, Pudukkottai.

2. Heard the learned counsel on either side.

3. This petition was filed mainly on the ground that the accused persons are openly threatening the petitioner not to give evidence in the pending case. A status report has been filed by the first respondent. On going through the status report, it is seen that the respondent Police had taken cognizance of the complaint given by the petitioner to the effect that the petitioner was threatened by the accused persons. Accordingly, an FIR came to be registered in Crime No.258 of 2024. On registration of this First Information Report, the second respondent was arrested and remanded to judicial custody on 30.07.2024. The second respondent was enlarged on bail in this case by the learned Judicial Magistrate, Gandharvakottai on 05.08.2024. It is also mentioned that the investigation has been completed in both cases in Crime No.479 of 2022 2/5

and 258 of 2024 and the police report has been filed in both the cases. The second respondent was also reporting before the first respondent Police during the course of investigation.

In the light of the above development, the bail granted in favour of the petitioner need not be cancelled and it will suffice to make it clear that the second respondent will not make any other attempt to cause threat to any of the witnesses in this case and the case which is now pending in S.C.No.44 of 2023 on the file of the EC Court, Pudukkottai and C.C.No.61 of 2024 pending on the file of the learned Judicial Magistrate, Kandharvakottai shall be disposed of as expeditiously as possible.

5. This Criminal Original Petition is disposed of with the above directions.
