ORDER
Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the official respondents.
2. The petitioner had executed the gift deed in favour of his son / R5 herein. The petitioner moved the maintenance tribunal and thereafter withdrew the application. He then filed a representation before the first respondent. This writ petition has been filed for considering the said representation.
3. I wanted to know from the petitioner's counsel the relief sought for by the petitioner. The petitioner's counsel submitted that the petitioner is seeking maintenance from his son. If that be so, it is only the maintenance tribunal / Revenue Divisional Officer who can grant relief. The District Collector is the appellate authority. The petitioner cannot straight away go before the appellate authority. The petitioner is permitted to move the Revenue Divisional Officer, Usilampatti within one week. The petitioner's counsel states that such a petition will be filed before the second respondent within one week from the date of receipt of a copy of this order. The second respondent will take the 2/4
same on file immediately. Notice will be issued to the fifth respondent and others, if necessary. Final order on merits and in accordance with law will be passed within a period of two months after filing of the petition filed by the petitioner.
