RESPONDENT/RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition imposed on the petitioner by this Honorable court in CRL.A.(MD) No.247 of 2019 in MP(MD) No.9426 of 2019 dated 15.11.2019 on the file of this Honourable Court.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. AK. AZAGARSAMI, Advocate for the petitioner and of MR.K.K.RAMAKRISHNAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- (Order of the Court was made by T.RAJA. J.) This Miscellaneous Petition has been filed seeking to relax the condition imposed on the petitioner/appellant/A3, by this Court, vide order dated 15.11.2019, in Crl.M.P.(MD)No.9426 of 2019 in Crl.A.(MD)No.247 of 2019.
2.Learned counsel appearing for the petitioner submitted that this Court vide order dated 15.11.2019, in Crl.M.P.(MD)No.9426 of 2019 in Crl.A.(MD)No.247 of 2019, has directed the petitioner/appellant to stay at Vellore District and report before the Town Police Station everyday at 10.30 a.m. and 05.30 p.m. until 1/3
further orders. He further submitted that from 23.11.2019 onwards the petitioner has been complying the conditions promptly, therefore, the conditions imposed by this Court may be relaxed, so that, the petitioner can be able to eke out his livelihood by doing some daily coolie works.
3.At this stage, the learned Additional Public Prosecutor appearing for the respondents, after getting instructions from the respondents, submitted that from 23.11.2019 onwards the petitioner has been complying the conditions regularly without any deviation. 4.Considering the fact that there is no deviation on the part of the petitioner in observing the conditions imposed by this Court, the condition imposed on the petitioner is relaxed and the petitioner is directed to appear before the learned IV Additional District and Sessions Judge, Madurai, once in a month i.e., on the first working day of every English Calendar month until further orders.
