ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) 20(b), (ii)(B), 25, 29(1) Narcotic Drugs and Psychotropic Substances Act, 1985 in C.C.No.945 of 2023 on the file of the learned Principal Special Court for EC and NDPS Act Cases, Madurai in Crime No.494 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that when the respondent police was in patrolling duty, the petitioner herein and other accused have illegally found in possession of 3.500 kgs of ganja. Hence the case.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4. Considering the serious nature of allegations made against the petitioner, this Court is not inclined to allow this petition. 2/3

5. Accordingly, this Criminal Original Petition is dismissed. However, the petitioner is given liberty to surrender before the Trial Court and on such surrender, the trial Court is directed to consider the petition filed by the petitioner on its own merits on the same day itself.
