Prayer:

Writ Petition, filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, calling for the records pertaining to the impugned enquiry in TDP No.6 of 2020 on the file of the 1st respondent and quash the same.

ORDER : This Writ petition coming on for hearing on this day, under the caption for " extension of Time" and upon perusing the earlier order of this court dated 01.12.2022, and the requisition letter submitted by the Commissioner, Madurai vide the Roc.No.120/2020 dated 23.05.2023 in the presence of M/S. ALAGURAAM JOTHI.J, Advocate for the petitioner this court made the following order:- The petitioner filed this writ petition for quashing the proceedings. I did not entertain the writ petition only for the reason that the trial had already commenced. The writ petition was disposed of with a direction to the Commissioner of Disciplinary Proceedings, Madurai to conclude the proceedings within six months. Since the time limit stipulated by this Court could not be adhered to, extension was sought.

Extension was given and it was directed that the proceedings should be concluded by the end of August 2023. Now for the second time, extension has been sought. It is stated that the examination of witnesses has been concluded and that the Tribunal would conclude the proceedings after hearing both sides.

2. No purpose will be served by denying extension. However, the Commissioner of Disciplinary Proceedings is directed to hear the arguments of both sides by 25.09.2023. I make it clear that this time limit should be strictly adhered to. This Court will not entertain any further request for extension of time. Both sides are directed to extend their cooperation. The request of the Commissioner is disposed of accordingly.
