This petition has been filed to condone the delay of 131 days in preferring the judgment dated 20.01.2023 passed in MCOP No.59 of 2018 on the file of the MACT / Subordinate Judge, Paramakudi.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.

3. Respondent No.1 has been served with notice and represented through counsel. The second respondent remained exparte before the Tribunal. The Insurance Company is only questioning the quantum. Hence, notice is dispensed with insofar as the second respondent.

4. Considering the reasons assigned in the affidavit filed in support of the petition, this petition is allowed and delay is condoned.

5. Registry is directed to number the petition if it is otherwise in order and is further directed to print the name of Mr.K.Kumaravel, learned counsel for the first respondent at the time of posting the main appeal for admission.
