For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) For Intervener : Mr.J.Jeyakumaran, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No 452 of 2018 on the file of the Respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner, the learned Government Advocate(Crl. Side) appearing for the respondent and the learned counsel for the intervener.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 420, 294(b), 506(i) of I.P.C., in Crime No. 452 of 2018 on the file of the respondent police, seeks anticipatory bail.
3. The intervener pointed out that the petitioner's husband had recently received a sum of Rs.75,00,000/-. Be that as it may, the 1/3
petitioner came forward to pay a sum of Rs.1,00,000/- immediately. The petitioner also states that she will give a standing instruction to her employer so that a sum of Rs.10,000/- can be deducted from her monthly salary and credited to the account of the defacto complainant.
4.The learned counsel for the petitioner states that after withdrawing her salary, she would dutifully remit a sum of Rs.10,000/- to the bank of the defacto complainant. The principal liability is quantified at Rs.10,00,000/-. The petitioner's remittance will continue till the entire liability is cleared. If in the meanwhile, the balance amount can be received from A1 itself, ofcourse, the petitioner can be given the benefit of adjustment. The petitioner has also filed an affidavit to that effect. The same is taken on record. The relief of anticipatory bail is granted to the petitioner by recording her undertaking that she will clear her liability of Rs.10,00,000/-.
5. In the view of the above, I am inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate No.II, Srivilliputhur, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
