For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in C.C.No.399/2019 on the file of the Judicial Magistrate Court No.II, Dindigul.
ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner is shown as accused in C.C.No.399 of 2019 on the file of the Judicial Magistrate No.II, Dindigul. The petitioner is figuring as A3 in the said case for the offences punishable under Sections 406, 420, 120(b), 465, 468 and 471 of IPC in Crime No.637 of 2016 on the file of the respondent police, seek anticipatory bail.
3.The petitioner earlier granted anticipatory bail by me in Crl.O.P.(MD)No.7832 of 2019 dated 22.10.2019. The petitioners did not surrender within the time stipulated. Hence, he has filed a second petition for anticipatory bail.

The learned Government Advocate (Crl.side) submits that the absconding charge sheet was filed against the petitioner herein. 5.The petitioner's counsel states that the petitioner will appear before the learned trial Magistrate on the next hearing date. 6.Recording the said undertaking, I am inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Dindigul, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
