ORDER

(Order of the Court was made by G.R.Swaminathan J.) The petitioner herein filed W.P(MD)No.13358 of 2024 for removing the encroachment committed by one Ravi and Balamuruga Maharaja in the petition mentioned lands. The writ petition was disposed of by the Division Bench on 21.06.2024 in the following terms: "4. When the matter was taken up for hearing, learned Additional Government Pleader submitted that a survey is proposed to be conducted on 22.06.2024 and that if encroachments are identified, action will be taken to remove the same by adhering to due process of law." Contending that the undertaking given before the Court was not complied with, this Contempt Petition has been filed. 2/5

2.When the matter was taken up for hearing, the learned Government Advocate submitted that notice was issued to the encroachers as early as on 02.07.2025 informing them that if they do not vacate on their own, they would be summarily evicted. Thereafter, the encroachers had filed O.S.No.108 of 2025 on the file of the District Munsif cum Judicial Magistrate No.1, Usilampatti seeking permanent injunction. The highway authorities are one of the defendants in the suit. The next hearing date is 28.04.2026.

3.The respondents are directed to intimate the plaintiffs in the said suit that if they fail to obtain injunction or interim relief within a reasonable period, notice dated 02.07.2025 would be enforced. 4.With the aforesaid direction to the respondents, this Contempt Petition is closed.
