Heard Mr. T.Lenin Kumar, Learned Counsel for the Petitioner, Mr. D.Gandhiraj, Learned Special Government Pleader appearing for the First Respondent and Mr. Mr.H.Arumugam, Learned Counsel appearing for the Second and Third Respondents and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition has been filed by the Petitioner seeking for a direction to restrain the Respondents 1 to 3 from opening a TASMAC Shop No.6624 in the undivided agricultural land measuring to an extent of 0.40.00 Hectares comprised in Survey No.427/D, situated at Athani South Village, Aranthangi Taluk, Pudukottai District.

Learned Counsel appearing for the Third Respondent, on instructions, submitted that the Third Respondent does not have any proposal for opening TASMAC Shop in the aforesaid property and he has also filed a memo dated 05.12.2022 to that effect, which is placed on record. 4.
