Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the Tender Notice No.4/VBC/C.T-N/2025-2026 1/5

(Vernacular and English) dated 18.08.2025 issued by the 2nd respondent and quash the impugned condition under Serial No.11 requiring the upload of a site visit certificate from the 3rd respondent and consequently direct the respondents to permit the petitioner to participate in the Tender by allowing the upload of its tender application on the portal on or before 02.09.2025 upto 3.00 p.m. without insisting on the said certificate.

ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Government Advocate appears on behalf of the respondents.

2.This Writ Petition has been filed challenging Tender Notice No. 4/VBC/C.T-N/2025-2026 (Vernacular and English) dated 18.08.2025 issued by the 2nd respondent.

3. It is noticed that the 1st respondent floated a tender on 18.08.2025, which requires the submission of a site inspection report on or before the last 2/5

date fixed for submitting the bid.

4. It is submitted that the petitioner made an application for issuance of the site inspection report on 25.08.2025. However, till date, the report has not been issued. It is further submitted that unless the petitioner secures the said report by 02.09.2025, he will be disqualified from participating in the tender process.

5. The learned counsel for the petitioner drew attention to the decision rendered by this Court in W.P.(MD) Nos.15667 and 15668 of 2025, dated 10.06.2025.

6. The learned Government Advocate appearing for the respondents, on the other hand, submitted that the petitioner can visit the site tomorrow at any time.

7. The learned counsel for the petitioner submitted that the petitioner will be present at the site on 30.08.2025 between 11.00 a.m. and 12.00 noon. 3/5

8. Recording the aforesaid submission, there shall be a direction to the petitioner to be present at the site tomorrow between 11.00 a.m. and 12.00 noon. The 2nd respondent shall also be present at the site during the said time and thereafter issue the site inspection report to the petitioner, thereby enabling him to submit his bid on 02.09.2025.

9. With the above direction, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petitions are closed. No costs. 29.08.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No Indu To 1.The Superintending Engineer, Water Resource Department, Vaipar Basin Circle, Virudhunagar.
