Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st and 2nd respondents to provide the necessary police protection to the petitioner and his employee's life and limb and to conduct his waste paper and old materials business in the Trichy Town based on petitioner's representation dated 14.08.2025.

ORDER
This Writ Petition is filed for Mandamus to direct the respondents 1 and 2 to provide necessary police protection to the petitioner and his employees and to conduct waste paper and old materials business in Trichy Town based on the petitioner's representation dated 14.08.2025.
2. It is the case of the petitioner that the third respondent and other employees under his leadership are preventing the petitioner from employing other labourers for loading and unloading of the petitioner's goods; and that the third respondent is heading an Association.

Mr.S.Muthukrishnan, learned counsel for the third respondent would submit that the third respondent or the other employees had never prevented the petitioner from engaging any other workers for the aforesaid purposes; and that they would not resort to any illegal activities. The third respondent also had filed an affidavit, the relevant portion of which reads as follows: 2/5
"4. I state that as a responsible trade union in the Gandhi Market we are functioning in peaceful manner and solving our demands in the presence of the Joint Commissioner of Labour, Tiruchirappalli. I hereby undertake that our Union and its members will not resort to any illegal activities and cause disturbance to the peaceful functioning of the petitioner and other owners business. If members of our union resort to any illegal activities and create any law and order problem, the law and order authority can proceed against them in accordance with law. I assure that our union and our members will maintain the peace and we solve our demands in accordance with law.
5. I state that I hereby under take that I will not resort any illegal activities against any individual owner in his peaceful functioning of his business. I will be a law abiding citizen."
4. Heard the learned Additional Public Prosecutor appearing for the respondents 1 and 2.
5. It is needless to say that the third respondent or any other person cannot illegally prevent the petitioner from doing his business or engaging any person for his business activities. The third respondent has also filed an affidavit that he or other employees would not interfere in the petitioner's business activities.

6. In view of the above, there shall be a direction to the respondents 1 and 2 to ensure that the petitioner carries on his business activities without any illegal interference from either the third respondent or any other employee as and when need arises.
7. With the above observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
