PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the Revenue Divisional Officer, Uthamapalayam, the 1st respondent herein to set aside the proceedings in T.R. No.2022/0103/25/078125TR dated 17.08.2022 and proceedings in T.R. No. 2023/0103/25/086218TR dated 06.02.2023 in respect of the joint patta granted in favour of the 3rd respondent in respect of the property situated at Veeruchinnamalpuram, Poodhipuram Village, Bodinayakanur Taluk, Theni District of an extents of 13 cents in Survey No.172/2, 29 cents in Survey No. 175/8 and 7 cents in Survey No.175/5 by considering the representation/appeal of the petitioner dated 07.08.2025 and pass appropriate orders within a stipulated period.

ORDER

After submitting an appeal to the jurisdictional Revenue Divisional Officer seeking cancellation/modification of the joint patta issued to the third respondent, the present writ petition has been filed. 2.The petitioner has asserted that the survey No.175/5 was owned by the children of Veerachamy Pillai. He further submits that the third respondent herein obtained the impugned joint patta by unlawful means. In spite of presenting the appeal, it is stated that such appeal has not been considered till date.

3.Learned Government Advocate accepts notice on behalf of the first and second respondent. He submits that the appeal would be disposed of within 12 weeks from the date of receipt of a copy of this order. 2/4

4.Given the nature of relief claimed, it is not necessary to put the third respondent on notice in this writ petition; instead, without making any observations on the merits, this writ petition is disposed of by directing the first respondent to consider and dispose of the petitioner's appeal dated 07.08.2025 within 12 weeks from the date of receipt of a copy of this order after providing reasonable opportunity to the petitioner, the third respondent and other joint pattadhars in respect of the relevant property.
