PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle interest at the rate of 6% per annum for the belated payment of the petitioner's terminal benefits including Provident Fund, Gratuity and Leave Salary from the date of his retirement i.e., from 30.06.2022 to 23.05.2023, the date on which the said benefits were settled to him. 1/4

O R D E R

The present Writ Petition has been filed by a Selection Grade Conductor, who attained superannuation on 30.06.2022. The terminal benefits were released on 23.05.2023. The petitioner sent a representation to the respondents on 03.07.2023 seeking interest at the rate of 6% per annum for the belated payment including Provident Fund, Gratuity and Leave Salary from the date of his retirement i.e., from 30.06.2022 to 23.05.2023.

2. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.

3. Considering the above said facts, the second respondent is directed to pay interest for the belated disbursement of the terminal benefits at the rate of 6% p.a., from the date of the petitioner's retirement till the date of realization within a period of twelve weeks from the date of receipt of a copy of this order.
