O R D E R

The desperate mother having settled the properties in favour of her son is before this Court seeking Writ of Mandamus to the first respondent, who is the Revenue Divisional Officer, Virudhunagar District to take action against her erring son, who is the fourth respondent herein, under the provisions of Maintenance and welfare of Parents and Senior Citizens Act 2007.

2. Mr. Pandiarajan, learned Additional Government Pleader takes notice for the respondents 1 & 3 and Mr.M.Murugan, learned Government Advocate takes notice for the second respondent.

3. Heard both sides and perused the documents.

4. It is seen from the records that the representation of https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.26125 of 2019 the petitioner was made on 06.11.2019 and enquiry was fixed on 29.11.2019. It is stated that on the date of enquiry, the petitioner appeared and the 4th respondent had not turned up. Further it is stated that without giving next date of hearing, the matter was adjourned. Hence, this Writ petition is filed by the petitioner.

Considering the nature of relief sought for by the petitioner and without going into the merits of the case, the first respondent herein is directed to conduct enquiry and pass appropriate orders as contemplated under the provisions of Maintenance and welfare of Parents and Senior Citizens Act 2007, within a period of six weeks, affording them an opportunity of personal hearing of both parties including the fourth respondent and any other person who are all interested in this regard.

6. With the above direction, the Writ petition is disposed of. No costs.
