PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle interest at the rate of 6% per annum for the belated payment of 1/5

petitioner's terminal benefits including Provident Fund, Gratuity, Terminal Leave Salary and Commuted value of pension from the date of his retirement i.e., from 31.05.2022 to 23.05.2023, the date on which the said benefits were settled to him.

O R D E R

The present Writ Petition has been filed by a retired Selection Grade Driver seeking a mandamus directing the respondents to settle the interest at the rate of 6% per annum for the belated payment of terminal benefits. The petitioner had attained superannuation on 31.05.2022 and retirement benefits were disbursed on 23.05.2023. The petitioner has sent a representation to the respondents on 07.07.2023, seeking interest for the said belated payment of terminal benefits.

2. Heard the learned counsel appearing for the petitioner and the 2/5

learned Standing Counsel appearing for the respondents.

3. Considering the above said facts, the second respondent is directed to settle the interest for the belated disbursement of the terminal benefits at the rate of 6% p.a., from the date of the petitioner's retirement till the date of realization within a period of twelve weeks from the date of receipt of a copy of this order.
