O R D E R

The learned Senior Counsel appearing for the petitioner submitted that in spite of the tripartite agreement, the respondent has subsequently insisted to lay the road. Before this Court, both the parties stated that a tripartite agreement was entered into. A specific stand was taken by the respondent based on the tripartite agreement, the writ petition has become infructuous.

2. In fact, this Court refused to record such a statement since it cannot be infructuous. Therefore, this Court recorded that the earlier agreement has been replaced by the tripartite agreement. Now, the petitioner is taking a stand that the petitioner is not bound to relay the road. But the respondent is taking a stand that the petitioner is bound to relay the road. When there is no consensus under the agreement then the tripartite agreement cannot be accepted.

3. Accordingly, this Court is inclined to recall the earlier order dated 07.07.2025 and post the writ petition in W.P.(MD)No.6981 of 2025 before the Portfolio Judge for rehearing. There shall be an order of interim stay of all proceedings until the writ petition is disposed of and Sub Application(MD)No. 403 of 2025 is accordingly ordered.
