O R D E R

This Criminal Original Petition has been filed seeking for modification of one of the condition that was imposed by the Court below, where, the Court below insisted for one blood surety apart from one normal surety.

2.According to the petitioner, he is not in a position to get a blood surety in this case and in view of the same, the petitioner is not able to comply with the condition imposed by the Court below and as a result, the incarceration of the petitioner continues.

3.Heard the learned Counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent police. 4.Taking into consideration of the facts and circumstances of the case and also the manner, in which, the offence had taken place in this case and also considering the fact that there are no previous antecedent against the petitioner, the first condition imposed by the Court below is modified as follows:

(i)The petitioner is ordered to be enlarged on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties, each for a like sum to the satisfaction of the learned District Munsif Cum Judicial Magistrate, Rameswaram.

5.The other conditions imposed by the Court below shall stand as it is.

6.This Criminal Original Petition is disposed of, with the above modification.
