ORDER

The petitioner seeks a direction to the first respondent to grant ECNR (Emigration Check Not Required) status in the petitioner's passport, based on the application pending in File No. MD1075312358725 dated 10.07.2025, on the strength of the petitioner's eligibility as an Indian citizen residing abroad for more than three years.

2. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) submitted that the petitioner is involved in a criminal case in FIR No.138 of 2023 on the file of the second respondent and the charge sheet is going to be filed and therefore, the request of the petitioner cannot be acceded to for the present.

3. In view of the above submission, the request of the petitioner cannot be considered at this stage. As and when the said proceedings are concluded, it is open to him to renew his request. Accordingly, this writ petition is dismissed. No costs.
