(Order of the Court was made by DR.ANITA SUMANTH, J.) The present petition is filed by one Ramadoss, who claims to be aggrieved by an order passed by the writ Court on 27.06.2025 in W.P(Crl)(MD)No.300 of 2025. The Writ Petition was filed by Rev.Father.Jerome, Parish Priest, seeking a Mandamus directing the Inspector of Police to provide police protection to fence the church property in Survey Nos.82/7 and 82/8. 2.It is unclear whether any counter was filed by the respondents in the said Writ Petition. The Writ Petition came to be disposed on 27.06.2025 on the basis of the submissions of the writ petitioner, to the effect that the judgment dated 06.12.2000 in O.S.No.177 of 2003 on the file of the Principal District Munsif Court, Pudukkottai, is in favour of the writ petitioner, who has obtained a permanent injunction with regard to the same property. In the absence of any counter filed by the District Collector, the nature of the property and its classification in the revenue records have not been gone into. 1/3

3.While so, it is the case of the petitioner before us to the effect that the property which admeasures 4041 square meters includes, inter alia, a public pathway.

4.We are of the view that there ought to be clarity as to whether a Mandamus of the nature issued under order dated 27.06.2025 ought to have been granted. In order to decide the same, it would be necessary to hear the version of the present petitioner as well.

5.For the aforesaid reasons, we grant leave and this Miscelleaneous Petition is ordered.

6.Registry is directed to number the Writ Appeal, if it is otherwise in order, and list the same for admission.
