ORDER : The Court made the following order :- The petitioner / Sole Accused, who was arrested and remanded to judicial custody on 03.08.2024 for the alleged offence under Sections 5(1), 5(m), 5(n), 5(j)(ii), r/w. 6(1) of POCSO Amendment Act, 2019 and Sections 342, 506(i) of IPC, in Crime No.6 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner committed sexual assault on the victim who was aged about 12 years. She became pregnant and she also delivered a child.

3. This Court, on carefully going through the statement recorded under Section 164 of the Code of Criminal Procedure, expressed its mind that this Court is not inclined to enlarge the petitioner on bail.

4. In view of the above, learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.

5. Recording the same, this Criminal Original Petition stands dismissed as withdrawn.
