The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 75,85, 115(2), 296(b) and 351(2) of BNS, 2023, in Crime No. 10 of 2024 on the file of the respondent police, seek anticipatory bail.

The case of the prosecution is that the defacto complainant was treated with physical and mental cruelty by A1 and A3 and insofar as A2, who is the father-inlaw, apart from treating the defacto complainant with cruelty, he also attempted to make sexual advancement towards the defacto complainant. 3.
The marriage had taken place in the year 2010 and there are two children out of the wedlock and the actual dispute seems to have started from the year 2022 when the husband faced a kidney failure and came back to India from Singapore and underwent a kidney transplantation. There are totally three accused persons in this case and the petitioners are A1 and A2. A3 was already granted anticipatory bail in Crl.O.P.(MD) No.18835 of 2024, by order dated 29.10.2024.
4. Heard the learned counsel on either side and perused the material records of the case.

Taking into consideration the facts and circumstances of the case and the nature of allegations made in this case and also taking into account the fact that the matrimonial dispute is involved in this case, this Court is inclined to direct the respondent police to follow the procedure under Section 35 of BNSS, 2023, and 3/5
complete the investigation as expeditiously as possible.
