Mr,K.Govindarajan Deputy Solicitor General of India PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- To enlarge the petitioner/accused No.3 on bail in C.C.No.10/2021, on the file of the respondent.
ORDER : The Court made the following order :- The petitioner/A3, who was arrested and remanded to judicial custody on 1/3
30.09.2024 for the offences under Sections 3 and 4 of PMLA Act r/w Section 8(5) of PMLA in C.C.No.10 of 2021 before the learned II Additional District Judge (CBI Cases), Madurai, seeks bail.
2.Heard the learned Counsel appearing on either side. 3.In the instant case, the petitioner is facing trial before the Court below for offence under Sections 3 and 4 PMLA 2002 r/w 8(5) of PMLA. There are totally three accused persons and the petitioner has been arrayed as A3. The case is pending from the year 2021 onwards before the Special Court. Non bailable warrant was issued against the petitioner in the year 2022 and ultimately, it was able to be executed only during September 2024. Thereafter, the petitioner was produced before the Court and he is now in judicial custody. 4.The learned Deputy Solicitor General of India appearing for the respondent submitted that due to the abscondence of the petitioner, there has been absolutely no progress in this case and till date, not even charges have been framed. The learned Deputy Solicitor General of India further submitted that one of the accused persons namely, A2 died and the other accused persons are appearing before the Court below.
5.Taking into consideration the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail since the petitioner has jumped bail and he was able to be secured only after two years after the non bailable warrant 2/3
was issued. Therefore, this Court wants to see some progress made in this case and thereafter, this Court will consider granting bail to the petitioner. 6.In the light of the above discussion, this criminal original petition stands dismissed for the present.
