PRAYER :- This Writ Appeal is filed under Clause 15 of Letters Patent Act too prefer this Memorandum of Grounds of Writ Appeal against the order dated 05.12.2018 passed by this Court in WP(MD)No.13179 of 2015.

JUDGMENT

(Judgment of the Court was made by R.VIJAYAKUMAR., J.) The petitioner in WP(MD)No.13179 of 2015 has preferred the present Writ Appeal challenging the order of the writ court dated 05.12.2018.

2.The first respondent in writ petition had approached the authority under the Conferment of Permanent Status Act seeking permanent status as a Clerk and an order was passed in his favour by the second respondent in writ petition on 05.03.2014. The said order was put to 2/5

challenge by the Agricultural Credit Co-operative Society in WP(MD)No.13179 of 2015 and the writ petition came to be dismissed on 05.12.2018 confirming the order passed by the statutory authority. Challenging the said order, the present appeal has been filed by the Society. Pending Writ appeal, the first respondent who had the benefit of conferment of permanent status as a Clerk, has filed an affidavit dated 18.11.2025. In paragraph No.3 of the said affidavit is extracted as follows:

''I humbly submit that the writ petition filed by the Appellant herein before this Hon'ble Court dismissed on 05.12.2018. Against which this writ appeal is filed. Now, I am working in the Appellant Society as a Jewels appraiser on commission basis. I am hereby giving undertaking that I am willing to continue in the post of Jewels Appraiser in the Appellant Society and I am not ready to contest the present writ appeal. More particularly, to that effect I had given written submission on 09.09.2025 before the Authority concern that I am willing to continue in the post of jewels appraiser on commission basis''.

3. In view of the above said undertaking given by the writ petitioner/the first respondent in the Writ Appeal, we are of the 3/5

considered opinion that the writ petitioner may continue as a Jewel Appraiser on commission basis in the appellant Co-operative Society and he has given up his right of conferment of permanent status as a Clerk.

4. In view of the said facts, this Writ Appeal is disposed of after recording the affidavit filed on behalf of the first respondent. No costs. (C.V.K., J.) (R.V.,J.) 19.11.2025 CM TO
