ORDER : The Court made the following order :- The petitioner was arrested on 01.02.2024, pursuant to a non bailable warrant of arrest issued against him in Spl.S.C.No.329 of 2023, which is pending on the file of the Special Court for POCSO Act Cases at Dindigul. This is the third petition filed by the petitioner, seeking bail.
2. On 20.06.2024, this Court, considering the manner in which the petitioner has evaded the trial and the case which was registered in the year 2018, is pending without any progress, dismissed the earlier bail application with a direction to the Trial Court to conclude the trial within a stipulated time.
3. The petitioner has filed the present petition that despite the earlier order of this Court dated 20.06.2024 fixing the time limit, the trial has not been completed and therefore, the petitioner may be enlarged on bail.
4. The learned Government Advocate (Crl. Side) submits that the trial Court has proceeded with the trial, however, the trial could not be conducted due to the boycott announced by the local Bar Associations in protest of implementation of New Criminal Laws. He further submits that the Trial Court has examined 13 witnesses out of 29 witnesses and also posted the case for examination of witness Nos.14 to 16 on 11.11.2024.
5. Considering the submission made by the learned Government Advocate (Crl. Side) that the trial has commenced and most of the witnesses have been examined, 2/4
